After all, the injuries a pedestrian sustains in an automobile accident are usually quite serious and can last for a lifetime.

According to the National Highway Traffic Safety Administration, a pedestrian is injured in an accident every eight minutes in the U.S. Sadly, automobile accidents involving pedestrians result in 5,000 deaths every year and over 70,000 injuries. Head injuries are the most common type of injuries, followed by injuries to the chest and abdomen. The likelihood of a pedestrian surviving a car accident is linked to the age of the victim and the speed at which the vehicle was traveling.

Studies have shown that almost half of all accidents between and automobile and a pedestrian are attributable to the driver failing to yield. About a third of these accidents were hit and runs. Over half of the accidents involved a vehicle making a turn.

If you have been injured in a pedestrian accident in Allen, there are steps you should take immediately after the accident that can have a big impact on your ability to recover damages from the responsible driver. In order to recover, you must be able to establish that the driver was negligent and that you suffered injuries as a result. Typically, you would order medical records, obtain statements from eyewitnesses, take pictures of the accident scene, obtain police reports, and obtain any surveillance videos of the area.

Accident victims who are represented by an attorney on average recover more in damages than those who represent themselves, even after the attorney’s fees are deducted. What should I do if I was hit by a driver who fell asleep behind the wheel in Dallas?

Driving while tired is extremely dangerous, although it’s a behavior that doesn’t get much press. Although everyone knows not to drive while texting or drive while drinking, there is not much publicity about the dangers of driving while drowsy.

However, evidence shows how extremely dangerous it can be to drive while drowsy. According to the National Highway Traffic Safety Administration, over 100,000 automobile accidents every year are caused by drowsy drivers. Those accidents kill 1,550 people and injure another 70,000.

There have been several studies in recent years that have looked at the dangers of driving while sleepy. One study found that drivers who did not sleep well over the previous 20 hours had response speeds that were only half those of well-rested drivers. Another study found that drivers with only four hours of sleep the night before were equivalent to drivers with a blood alcohol content of twice the legal limit. Also, drivers who are drowsy are more than twice as likely to cause an accident as a driver who has had enough sleep.

Although there are not laws about how much sleep one must get in order to operate a motor vehicle, sleepy drivers who cause accidents in Dallas can be held legally liable for any personal injuries or wrongful deaths they cause as a result of their behavior. It can be difficult to prove that a driver caused an accident because he or she was sleepy, but a qualified attorney can help you build your case through expert witnesses, accident reconstruction, and any relevant work or medical documents.

Call the personal injury attorneys at the Barber Law Firm at 972-231-5800 if you have been hurt by a drowsy driver. You have legal options and we can help. Call today to learn more or to schedule a free consultation on your case.

Dallas Man Claims Self-Driving Car Caused an Accident

A Dallas man claims that his car drove him into a guardrail at 80 miles an hour. The accident has raised many questions about the safety of self-driving cars. The man was driving a Tesla, which was on autopilot in Kaufman in August. He was driving on Highway 175, and says he has driven that road in autopilot at least a dozen times.

He reached down to pet his dog that was riding with him, and grabbed a rag to clean the screen of the car’s computer system. When he looked up, the car had hit a curve in the road at 80 miles an hour and slammed into the guardrail. He says that the car did not stop then, but instead accelerated again. His dog jumped in the backseat, and he says the next thing he remembers is waking up with blood on his shirt lying inside several airbags. He had cuts, bruises, and a concussion.

This accident is the latest in a number of self-driving car accidents. In May, the National Highway Traffic Safety Administration investigated the first ever reported fatal accident involving Tesla autopilot. That crash killed the driver of the Tesla.

The federal government is currently working on new guidelines and regulations for Tesla’s autopilot feature, but it is uncertain when those will be released. An investigation into the fatal Tesla accident is still underway. According to Tesla, the vehicle does not become a self-driving vehicle even when in autopilot, and drivers must keep their hands on the wheel at all times.

As new technology involving self-driving cars continues to develop, there are likely to be many more accident involving self-driving cars. It’s uncertain whether the manufacturer of the vehicles will bear all of the responsibility for those accidents. If you have been in a car accident because of a vehicle defect, call the Dallas automobile accident attorneys at the Barber Law Firm at 972-231-5800. We can help. Two Motorcyclists in Critical Condition after Dallas Accident

A chain reaction accident shut down part of I-30 in west Dallas last weekend. The accident left two motorcyclists in critical condition. An accident occurred, and several motorcycles were unable to stop and crashed into the first accident scene. An investigation is underway.

Tragically, approximately 5,000 motorcyclists are killed every year and over 80,000 are injured in accidents in the U.S. Over the last several decades, the majority of motorcycle fatalities have occurred because of multiple vehicle crashes, such as occurred in this accident. When a motorcyclist is hit by an automobile, typically the motorcyclist suffers serious injuries because of the lack of protection that a motorcycle provides. Some common injuries include broken bones, cuts, back and neck injuries, brain injuries, and in some cases death.

A motorcycle accident can result in substantial medical expenses as well as an inability to work. This can cause a significant financial impact for the injured cyclist and his or her family. A study performed about 10 years ago which looked at the costs of motorcycle accidents found that the average cost for hospital charges for motorcycle accidents was over $65,000, and does not include the costs to the individual after he or she is released from the hospital.

If you or a loved one has been injured in a motorcycle accident, call the Dallas motorcycle accident attorneys at the Barber Law Firm at 972-231-5800. We can help. Call today to learn more or to schedule a free consultation.

Frisco Defective Products Attorneys

Dangerous and defective consumer products are much more common in the marketplace than most people realize. According to the U.S. Consumer Product Safety Commission, almost 30 million people are injured every year as a result of dangerous products. Some examples of dangerous products that injure consumers include defective drugs, defective automobiles, and defective children’s products and toys.

Generally, there are three types of defects for which an injured consumer in Frisco can make a claim. The first is design defects – this means that there is an inherent problem with a design of a product, and all products have the same issue. The second type of defect is a manufacturing defect. These are products that have safety issues because of manufacturing errors, not because of their design. The final category of defect is a failure to warn. With a failure to warn, the product may not be inherently unsafe, but may be unsafe when used in a certain manner – for example, if a drug is unsafe if combined with other types of medications.

Many of the injuries caused by defective or unsafe products in Frisco can be fatal, and those injured have the right to demand compensation for their expenses and physical and emotion trauma. If you have been injured by a defective consumer product, it is important to weigh all of your options, and to pursue compensation so that you are not saddled with a financial burden in addition to your injuries.

If you have been injured because of a defective consumer product in Frisco, call the Texas defective products attorneys at the Barber Law Firm at 972-231-5800. We can help. Call us today to learn more or to schedule a free consultation on your case.

What are the legal rights of injured truck drivers in Dallas?

There are a huge number of large commercial trucks on the roads in Dallas, transporting goods for consumers. Truck drivers may suffer from tight schedules, exhaustion, increasing amounts of pressure, and traffic snags, all of which can cause them to attempt to get their loads to the destination more quickly, which can lead to accidents.

Truck drivers who are injured in an accident in Dallas are entitled to compensation, regardless of whether or not the accident was their fault. Most injured truck drivers qualify for workers’ compensation, which will pay damages even if they are at fault for the accident. Workers’ compensation will provide money for medical expenses and a portion of lost wages.

If a third party, such as another driver on the roads, was the one responsible for the accident, the injured truck driver can sue that individual or business for damages as well. The negligent driver can be forced to pay for other damages that are not covered under workers’ compensation, such as pain and suffering.

The process of making a claim with either workers’ compensation or against a third party can be complex, and typically requires knowledge from an experienced attorney so that the claims are not denied. A qualified Dallas truck accident attorney can help ensure that the injured truck driver receives the benefits to which he or she is entitled. If you are a commercial truck driver and you have been injured in an accident in Dallas, call the Dallas truck accident attorneys at the Barber Law Firm at 972-231-5800. We can help. DART Train Hits Pedestrian

A man was hit last weekend after he walked in front of a southbound DART train at the West End station. According to a DART spokesman, the train operator tried to stop but could not. At the time of the accident, the pedestrian was not on a crosswalk. Fortunately, no one on the train was injured. The man was taken to Parkland Memorial Hospital, but his condition is uncertain.

Obviously, Dallas pedestrians are at high risk of harm, given that they are surrounded by large automobiles and because they lack the protection that automobiles offer. Tragically, every eight minutes in the U.S., a pedestrian is injured in an automobile accident. In the course of a year, automobile accidents involving pedestrians claim close to 5,000 lives, and injure another 70,000 individuals.

If a pedestrian is involved in an accident with an automobile in Dallas, the pedestrian may suffer extremely serious injuries, including broken bones, traumatic brain injuries, internal organ damage, and death. A recent study that looked at almost 6,000 pedestrian injuries found that the most common type of severe injury to pedestrians were head injuries, followed by injuries to the chest and abdomen, followed by injuries to the extremities. The study found that the speed at which the vehicle was travelling and the age of the pedestrian played a big role in the severity of the injuries and the odds of survival. About half of pedestrian-automobile accidents are due to drivers not yielding, and over half involve a vehicle that is turning.

Pedestrians who are hit by an automobile often suffer serious injuries or even death. If a pedestrian is injured in an accident, he or she may be able to recover damages for medical expenses, rehab expenses, lost wages, pain and suffering, and more.
